Introduction

Welcome to Vandra! These Terms of Service ("Terms") govern your use of Vandra, our mobile application and related services (collectively, the "Service"), which allow users to plan trips, explore trails and engage with outdoor adventures.

Acceptance of Terms

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of the terms, you do not have permission to access the Service.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of any changes by posting the new Terms on our website. Your continued use of the Service following any changes constitutes acceptance of those changes.

Use of the Service

  • Eligibility: You must be at least 13 years old to use the Service. By agreeing to these Terms, you represent and warrant that you are of legal age to form a binding contract with us.
  • Account Registration: You may need to register an account to access features such as trip planning, trail discovery, and wildlife logging.
  • Prohibited Uses: You agree not to use the Service in any way that is unlawful, harmful to others, or prohibited by these Terms.

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Vandra and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

User Content

Users of Vandra retain ownership of any text, images, data, or other materials they upload, share, or post through the Service (collectively, "User Content"), including trip plans, trail reviews, and shared itineraries, except for specific data related to wildlife observations as detailed below. By submitting User Content on Vandra, you grant Wildlfare a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, display, and perform the User Content in connection with the service provided by Vandra. This may include sharing your User Content with partner conservation groups, researchers, and other entities for the purpose of wildlife conservation and educational efforts. You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish and share User Content you submit.

Observation Data Rights

For clarity, any data submitted pertaining to wildlife observations, including but not limited to dates, locations, species identification, and related metadata ("Observation Data"), will be made available under the Creative Commons Zero (CC0) public domain dedication. This means that Observation Data contributed by users is dedicated to the public domain and may be freely used, distributed, and built upon by Vandra, its partners, and the general public without any restrictions. By submitting Observation Data, you waive any rights you may have in such data, allowing it to be used for conservation, educational, and scientific purposes without acknowledgment or compensation to you. You acknowledge and agree that Observation Data will not be considered confidential and will not be subject to the terms of privacy and confidentiality set forth in this agreement with respect to User Content.

Content Verification

Vandra endeavors to maintain the accuracy and integrity of User Content submitted to our platform, particularly concerning animal observations and related data. While we encourage a community-driven approach to data verification, Vandra may review and verify the accuracy of User Content to prevent misinformation. In cases of reported false reports, misidentification, or otherwise questionable User Content, we reserve the right to investigate and, if necessary, remove such content. Users are encouraged to contribute accurate information and may be asked to provide additional evidence or clarification to support their observations.

Location Data and Endangered Species

Protecting the privacy of our users and the wildlife they observe is paramount to Vandra. Location data is also used to suggest trails, campsites, or trip itineraries. However, special care is taken to handle location data for (potentially) endangered species. For such cases, Vandra may anonymize or restrict access to geographic details.

Responsible Wildlife Observation

Vandra is committed to promoting responsible outdoor practices. We encourage users to respect natural habitats, minimize environmental impact, and adhere to local regulations for trails, campsites, and wildlife. Educational resources may be provided to guide users in safe and sustainable outdoor exploration.

Prohibited Uses and Enforcement

Users of Vandra are strictly prohibited from using the Service for illegal activities, including but not limited to hunting, poaching or the illegal trade of wildlife. This includes the misuse of animal location data obtained through our Service. We take such violations seriously and are committed to protecting wildlife. In the event of suspected illegal activity, we will cooperate with law enforcement and may share user and device details with authorities to assist in investigations. By using Vandra, you consent to such cooperation and acknowledge our commitment to wildlife conservation and the enforcement of these Terms.

Termination

We reserve the right to terminate or suspend your account and deny access to the Service immediately, without prior notice or liability, at our sole discretion, for any reason, especially for breaches of these Terms. This includes, but is not limited to, misuse of the Service, engaging in illegal activities, or using the Service in a manner that harms or endangers wildlife. Upon termination, your right to use the Service will cease immediately.

Disclaimer of Warranties

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Liability for Outdoor Activities

Vandra is not responsible for injuries, losses, or damages resulting from outdoor activities, including but not limited to hiking, camping, or wildlife observation. Users must assess risks and follow local regulations and guidelines during their adventures.

Limitation of Liability

In no event shall Vandra, nor its owners, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

Governing Law

These Terms shall be governed and construed in accordance with the laws of The Netherlands, without regard to its conflict of law provisions.

Changes to the Service

We reserve the right to withdraw or amend our Service, and any service or material we provide via the Service, in our sole discretion without notice. We will not be liable if, for any reason, all or any part of the Service is unavailable at any time or for any period.
